Premarital agreements are a sensible precaution for clients entering into marriage when either or both of them have a sizeable number of assets and assets acquired after marriage. Premarital agreements define and protect the property a party had before marriage as that party’s separate property and protect it from division in a divorce situation in the unfortunate event the marriage is dissolved.  

Postnuptial agreements are executed after marriage to protect the assets of either party, defining the assets as that party’s separate property and protecting it from division if the marriage ends in divorce.
